Under §1a KSchG an employer terminating for urgent operational reasons (betriebsbedingte Kündigung) may offer 0.5 months of gross salary per year of service, payable only if the employee lets the three-week window for a Kündigungsschutzklage expire. This calculator models exactly that rate — 15 days per year of service — with a practical ceiling of 18 months, the range German labour courts typically settle within.

Notice follows the §622 BGB ladder, which is tenure-banded and independent of any severance: 30 days below 2 years, 60 days from 2 years, 90 days from 5 years and 120 days from 8 years of service, each running to the end of a calendar month or the 15th.

The decisive German feature is procedural rather than arithmetic: dismissal protection under the KSchG applies in establishments with more than ten employees once the employee has completed six months of service, and the works council (Betriebsrat) must be heard before any termination is valid. A dismissal issued without that consultation is void regardless of how much severance is offered.

For reference, the German statutory minimum wage stands at €2,409 per month in 2026, and social-security contributions continue to apply to a severance payment only in narrow cases — Abfindungen are generally free of social contributions but fully subject to income tax, softened by the Fünftelregelung (one-fifth rule) spreading the tax burden.
